Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using the NattyPet platform and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and NattyPet ("NattyPet," "we," "us," or "our"), operated from Brazil.

We reserve the right to update these Terms at any time. When we make material changes, we will notify you by email or through a prominent notice within the Service and update the Effective Date above. Your continued use of the Service after such notice constitutes your acceptance of the revised Terms.

2. Description of the Service

NattyPet is a web-based pet nutrition planning tool designed for tutors of dogs and cats who practice natural or home-prepared feeding (alimentação natural). The Service allows users to:

• Register pet profiles with information such as species, breed, age, and weight
• Log meals and track nutritional history over time
• Consult a database of foods and their nutritional composition
• Receive dietary planning references and calculations based on established nutritional guidelines

Nutritional calculations are based on internationally recognized guidelines, including those published by the National Research Council (NRC), the European Pet Food Industry Federation (FEDIAF), and the Association of American Feed Control Officials (AAFCO).

NattyPet is a dietary planning aid and is not a veterinary service. See Section 5 for the full disclaimer.

3. Eligibility

To use the Service, you must:

• Be at least 18 years of age, or the legal age of majority in your jurisdiction
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Service under applicable laws

By using the Service, you represent and warrant that you meet all eligibility requirements. NattyPet reserves the right to suspend or terminate accounts of users who do not meet these requirements.

4. Account Registration and Security

4.1 Account Creation

To access the Service, you must create an account by providing accurate, current, and complete information, including your name, email address, and payment details. You agree to keep this information up to date.

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must:

• Use a strong, unique password
• Not share your account credentials with any third party
• Notify us immediately at [email protected] if you suspect unauthorized access to your account

NattyPet will not be liable for any loss or damage arising from unauthorized use of your account resulting from your failure to protect your credentials.

4.3 One Account per User

Each user may maintain only one account. Creating multiple accounts to circumvent restrictions, access free trials, or abuse any feature of the Service is prohibited and may result in immediate termination of all associated accounts.

5. Important Health and Nutritional Disclaimer

NattyPet is not a veterinary service and does not provide veterinary advice, diagnosis, or treatment.

The nutritional calculations, dietary references, and food information provided through the Service are based on NRC, FEDIAF, and AAFCO guidelines and are intended solely as a dietary planning aid to assist tutors in organizing and tracking their pets' home-prepared diets.

5.1 Limitations of Nutritional Data

The nutritional values of foods stored in our database are reference values derived from published nutritional tables and scientific literature. These values may not accurately reflect the actual composition of the specific food products, ingredients, brands, or batches used by individual users. Factors such as growing conditions, processing methods, freshness, and regional variation can significantly affect the actual nutritional content of real-world ingredients.

Users are solely responsible for:

• Verifying the nutritional adequacy of their pet's diet with a qualified veterinary nutritionist or veterinarian
• Adjusting recipes and meal plans based on their pet's individual health status, response to diet, and veterinary guidance
• Understanding that calculated values are estimates, not guarantees

5.2 Consult Your Veterinarian

Always consult a licensed veterinarian or veterinary nutritionist before making significant changes to your pet's diet, particularly for animals with existing health conditions, allergies, chronic diseases, pregnancy, lactation, or unusual nutritional needs. NattyPet strongly encourages regular veterinary check-ups for all pets on home-prepared diets.

5.3 No Liability for Health Outcomes

NattyPet expressly disclaims any liability for adverse health outcomes in pets resulting from dietary decisions made based on information provided through the Service. The Service does not replace professional veterinary judgment. See Section 14 (Limitation of Liability) for full details.

6. Subscription and Payment

6.1 Paid Subscription

Access to NattyPet requires a paid subscription. Subscription plans are offered on a monthly or annual basis as described on our pricing page. All prices are displayed prior to purchase.

6.2 Billing

By subscribing, you authorize NattyPet (through its payment processor) to charge your chosen payment method on a recurring basis at the start of each billing cycle. Subscriptions renew automatically unless cancelled before the renewal date.

6.3 No Free Trial

NattyPet does not currently offer a free trial period. Access to the Service begins upon successful payment.

6.4 Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days' notice of any price change by email or through the Service. If you do not cancel your subscription before the new price takes effect, your continued use constitutes acceptance of the new price.

6.5 Taxes

Prices may be subject to applicable taxes (including VAT, GST, or local taxes) depending on your jurisdiction. You are responsible for any such taxes.

7. Cancellation and Refund Policy

7.1 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at [email protected]. Cancellation takes effect at the end of the current billing cycle. You will retain access to the Service until that date. There is no minimum commitment or cancellation fee.

7.2 Effect of Cancellation

Upon cancellation, your account will revert to an inactive state at the end of the paid period. You may request deletion of your data at any time in accordance with our Privacy Policy.

7.3 Refund Policy

NattyPet does not offer refunds for subscription fees, except in the following circumstances:

• Duplicate payment: If you were charged more than once for the same billing period due to a technical error
• Service unavailability: If the Service was materially unavailable or non-functional for a sustained and documented period during your active subscription, at NattyPet's reasonable discretion

Refund requests must be submitted within 30 days of the charge in question to [email protected] with supporting documentation. Approved refunds will be processed to the original payment method within 10 business days.

8. Acceptable Use

8.1 Permitted Use

You may use NattyPet solely for personal, non-commercial purposes related to planning and tracking the natural diet of your own dogs and/or cats.

8.2 Prohibited Conduct

You agree not to:

• Use the Service for commercial purposes without our prior written consent, including offering dietary planning services to third parties using NattyPet as a tool
• Share, resell, sublicense, or transfer your account or access to the Service to any third party
• Reverse engineer, decompile, or attempt to extract the source code, algorithms, or nutritional databases underlying the Service
• Scrape, crawl, or systematically extract data from the Service by automated means
• Input false or misleading pet data with the intent to manipulate results or abuse the Service
• Upload harmful content, including malware, offensive material, or content that violates third-party rights
• Attempt to circumvent security measures, authentication systems, or access controls
• Use the Service in a manner that violates any applicable law or regulation

8.3 Consequences of Violation

Violation of these rules may result in immediate suspension or termination of your account without refund, and may expose you to legal liability.

9. User-Generated Content

9.1 Content You Submit

You may upload photos, pet information, meal logs, and other content ("User Content") to the Service. You retain ownership of your User Content.

9.2 License to NattyPet

By submitting User Content, you grant NattyPet a non-exclusive, worldwide, royalty-free license to store, process, and display your User Content solely for the purpose of providing and improving the Service. We will not use your User Content for marketing purposes without your explicit consent.

9.3 Your Responsibility

You are solely responsible for the accuracy and legality of User Content you submit. You represent that you have all rights necessary to grant the above license and that your content does not infringe any third-party rights.

10. Intellectual Property

10.1 NattyPet's Property

The Service, including its design, interface, source code, nutritional database, algorithms, content, logos, and trademarks, is owned by NattyPet and protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership right in the Service.

10.2 Feedback

If you submit feedback, suggestions, or ideas about the Service, you grant NattyPet the right to use such feedback freely and without obligation to you.

11. Third-Party Services

The Service integrates with third-party providers, including payment processors (such as Stripe) and analytics tools. Your use of such third-party services is subject to their own terms and privacy policies. NattyPet is not responsible for the practices or content of third-party services.

12. Service Availability and Modifications

12.1 Availability

We strive to maintain the Service available 24/7, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

12.2 Modifications

NattyPet reserves the right to modify, update, or discontinue features of the Service at any time. We will provide reasonable notice of significant changes. If we discontinue the Service entirely, we will provide at least 30 days' notice and a pro-rata refund of any prepaid subscription fees.

13. Disclaimers

14. Limitation of Liability

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless NattyPet and its operators from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use of the Service in violation of these Terms
• Your User Content
• Your violation of any applicable law or third-party rights
• Any dietary decisions you make for your pets based on information from the Service

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms are governed by the laws of Brazil, without regard to conflict of law principles. For users in the European Union, mandatory consumer protection provisions of your local law also apply and are not affected by this clause.

16.2 Dispute Resolution

We encourage you to contact us first at [email protected] to resolve any dispute informally. We will make good-faith efforts to resolve concerns within 15 business days.

16.3 Jurisdiction

If informal resolution fails, disputes shall be submitted to the competent courts of Brazil. EU consumers may also bring claims before the courts of their country of residence. California users may have additional rights under applicable state law.

16.4 Class Action Waiver

To the extent permitted by applicable law, you waive any right to participate in a class action lawsuit or class-wide arbitration against NattyPet.

17. Consumer Rights (Brazil — CDC)

Users located in Brazil are protected by the Código de Defesa do Consumidor (CDC – Law No. 8,078/1990). Nothing in these Terms limits or waives rights granted to you under the CDC. In particular:

• You have the right to clear and accurate information about the Service and its limitations
• Abusive or misleading clauses are null and void under Brazilian law
• You may exercise your right of withdrawal (direito de arrependimento) within 7 calendar days of your first subscription purchase, for a full refund, pursuant to Art. 49 of the CDC, provided the request is made to [email protected]

18. Termination

18.1 By You

You may terminate your account at any time by cancelling your subscription and requesting account deletion via [email protected].

18.2 By NattyPet

We may suspend or terminate your account immediately if you:

• Violate any provision of these Terms
• Engage in fraudulent, abusive, or illegal activity
• Fail to pay subscription fees

In cases of termination for cause, no refund will be issued.

18.3 Effect of Termination

Upon termination, your right to access the Service ceases immediately. Sections 5, 10, 13, 14, 15, and 16 survive termination.

19. Miscellaneous

19.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NattyPet regarding the Service and supersede all prior agreements.

19.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

19.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right.

19.4 Assignment

You may not assign your rights under these Terms without our prior written consent. We may assign our rights freely.

19.5 Language

These Terms are written in English. In the event of any conflict between translated versions and the English version, the English version shall prevail, except where required otherwise by local law.
